Hello, in regards to tonights meeting, which I cannot attend, I would like to offer a comment on the subject of the Chelsea Hillcrest condo project.

I am the co-owner of one of these units, 1499 Duncan Ct, and wish to comment on the topic of sidewalks in our development. My wife and I feel sidewalks are unnecessary inside the development. There isn’t much space, they would not add value, and would add expense for us to maintain. We would prefer not having them.

Good morning Carol,

Thank you for your acknowledgement.  Chelsea Springs development has been in an uncomfortable position for the last number of years.  We are a private development with roads and infrastructure developed and maintained by our residents for the use of the association.  We are surrounded by land-locked properties proposing residential developments and relying on an easement provided in an old master deed for the original Chelsea Springs development.  We have attempted to develop agreements for access over Chelsea Springs roadways that provide the requested easement while protecting Chelsea Spring residents from  the detrimental effects of construction traffic and noise, resident traffic, and the additional road maintenance costs to our residents.  Negotiations are done with an eye toward preserving our resident’s property values and minimizing extra costs while working with the developers to allow access and this is a delicate balance to strike.

Chelsea Springs Board of Directors met last night and have requested that I respond on their behalf.

Regarding Mr. Trupiano’s comments on the Duncan berm, the language from our written agreement is, “Chelsea Hillcrest shall construct a berm in a manner that is mutually acceptable to Chelsea Hillcrest and Chelsea Springs across that portion of Duncan Drive where Chelsea Hillcrest and Chelsea Springs meet.”  We simply request that he honor the agreement made and offer a proposal for the berm he will construct.  We will review and comment to get the agreed berm in place.

In response to his comments regarding two entrances to Chelsea Hillcrest, one entrance onto private roads is very standard across communities.  Each Chelsea Springs street has a single access onto Coliseum Drive.  Chelsea Springs II was approved with a single access road over our Bristol Drive.  Gene Drive, which has proposals for development ongoing currently, has a single access onto Old US 12.  This is more normal than exceptional for private drives and cul de sacs.  That said, if the apartment development site plan is approved, technically Chelsea Hillcrest will have a fire access road available to the south over Pielemeier.  Mr. Trupiano could build a second access over his property to that road to alleviate his concern for the safety of his residents.

Mr. Trupiano has a number of issues outstanding with Chelsea Springs that we will be working with legal counsel to address.  His agreement with Chelsea Springs requires Chelsea Hillcrest to reasonably share in snow removal and maintenance costs for Coliseum Drive and it outlines a formula for the cost sharing.   Our 2021 invoice from last January remains unpaid despite numerous requests for payment and this needs to be resolved prior to his completion of his development at Chelsea Hillcrest and the 2022 snow removal season.

As a final note, regarding the apartment site plan up for consideration, we reviewed the proposal last night at our meeting.  We have a concern regarding the fire gate being proposed at the north end of the dirt road.  The gate might be sufficient to prevent ongoing vehicle traffic onto Chelsea Springs private roads, but we would request that the developers be required to build berms surrounding the gate on the left and right to prevent vehicles from simply driving around the gate.  On the map, there is a left branch of the dirt road that could be used to circumvent the gateway.  We would like that access shut off so the gateway would function as intended to block non-emergency access.  We would also like a requirement on the developer to control construction traffic so that it enters the site from Pielemier Drive and not via Coliseum Drive.

Good morning Carol,

Chelsea Springs just received a copy of a letter from the Chelsea Fire Department from Joe Trupiano regarding removing the barricade at the end of Chelsea Springs Duncan Drive.  It is disappointing to us to see the direction this is currently taking.

From our initial conversations with Mr. Trupiano, Chelsea Springs was clear that although we might come to an agreement for joint usage of Chelsea Springs private roadways, that we were unwilling to have that access via Duncan Drive.  With our “Stackable” units on that street it has a higher density of residents and therefore a higher inherent density of traffic.  In addition, there was horizontal parking in front of the units that made congestion in that area already.  Traffic from 17 additional Chelsea Hillcrest units via Duncan was not agreeable to us.  Mr. Trupiano readily agreed in writing as part of our signed agreement that a “mutually agreeable” berm would be constructed on Duncan and access to Chelsea Hillcrest would be via Coliseum Drive only.  No construction traffic was to travel on Chelsea Springs roadways.

It is my understanding that the initial planning board approval acknowledged that he would separate his residential development clearly from confusion with Chelsea Springs.  Despite that and his agreement with Chelsea Springs he built his road right up onto our street and named it Duncan Drive.  Pretty clear what the intention was.

Also in violation of the agreement, Duncan was continually used by Chelsea Hillcrest construction vehicles.  Chelsea Springs installed a temporary construction barricade to limit the heavy vehicle traffic and damage to Duncan Drive, and Chelsea Springs believed it was temporary until Mr. Trupiano built the contractually agreed barricade.  As he wraps up construction, we have on numerous occasions requested that he provide plans for a barricade, but we reasonably question if it was ever in his plans. He did request relief from the requirement from the planning commission earlier this year, even though it was a contractual obligation with Chelsea Springs.

Chelsea Springs has and would be open to discussion of what type of barricade Mr. Trupiano proposes to construct between the properties, but we would not be open to Duncan Drive for regular traffic and parking from Chelsea Hillcrest residents. Mr. Trupiano must abide by the agreement executed with Chelsea Springs.  If required in the end, his second egress should be over his property and not in violation of his written agreement with Chelsea Springs.

Chelsea Springs has reached out to legal counsel regarding the matter and other violations of our agreement with Chelsea Hillcrest, but we wanted to advise the planning commission prior to its meeting on Sept. 23rd, 2021 that Chelsea Springs will object to any discussions of removing the barricade on its property on Duncan Drive to provide open use by Chelsea Hillcrest residents.
